Terms of service
The short version. Ohmly is a tool. You are the qualified person. It does the arithmetic, holds the record and writes the document. The design decisions, the inspection and the declaration on any certificate remain yours, and nothing in these terms moves that responsibility to us.
1. Who we are, and what these terms cover
Ohmly is published by Proxime Technologies Ltd, a company registered in England and Wales, company number 17125907, registered office 71-75 Shelton Street, Covent Garden, London WC2H 9JQ. In these terms "we" and "us" mean that company, and "you" means the person using Ohmly.
These terms cover your use of the Ohmly app and this website. By installing or using Ohmly you accept them. If you do not accept them, please do not use it.
2. Who Ohmly is for
Ohmly is for people competent to carry out electrical installation work in the United Kingdom to BS 7671, or for people working under their supervision. It is built around UK domestic and light commercial practice and is not suitable for work under other national standards.
Apprentices and trainees are welcome to use it. The app does not make anyone competent, and nothing in it replaces training, supervision or qualification.
3. What stays your responsibility
Ohmly produces designs, drawings, calculations, checklists, costings, quotes and certificates from the information you give it. Every output depends on that information being right.
You remain responsible for checking that a design suits the installation in front of you, carrying out inspection and testing, the accuracy of every value you record, and the declarations you sign. Signing a certificate produced by Ohmly is your professional act, not ours.
Ohmly supports your professional judgement. It does not replace it. Every design, value, calculation and document it produces is a starting point for you to check, and you must satisfy yourself that it is right for the installation in front of you before you rely on it, install to it, or certify against it. Please do not treat the absence of a warning as confirmation that something is correct.
Responsibility for the installation, for the inspection and testing, and for every declaration on a certificate rests with the competent person carrying out or certifying the work. Nothing in Ohmly, and nothing in these terms, moves any part of that to us.
4. Standards
Ohmly cites regulation numbers so you can look them up. It does not reproduce the text of BS 7671, which belongs to its publishers. You should satisfy yourself that any value you rely on is right for the installation in front of you, as you would with any tool.
BS 7671 is published by the Institution of Engineering and Technology and the British Standards Institution. We are not affiliated with, endorsed by, or connected to either of them.
5. Certificates and competent person schemes
Ohmly produces its own certificate layout carrying the content required of an Electrical Installation Certificate, an Electrical Installation Condition Report or a Minor Electrical Installation Works Certificate. It does not reproduce the IET model forms.
We do not promise that any competent person scheme will accept a certificate produced by Ohmly. Schemes set their own requirements for their registrants, and some require particular forms or approved software. Please confirm the position with your scheme before relying on Ohmly for registered work. We are not affiliated with any scheme provider.
Ohmly does not notify work under Part P of the Building Regulations. It records a notification you made yourself in your scheme's own portal. Making that notification remains your responsibility.
6. Subscriptions and payment
Ohmly has a free tier and paid Pro and Pro+ subscriptions.
Subscriptions are sold to you by Google, not by us. Google Play takes the payment, sets the final price and tax you see before you confirm, and manages renewals. Your purchase is governed by Google's terms as well as these, and billing, renewal, cancellation and refunds are handled in your Google Play account. If you have a payment or refund problem, Google is the right place to take it.
Subscriptions renew automatically until you cancel. You can cancel at any time in Google Play, and you keep what you have paid for until the end of the period you have paid.
If you cancel, you drop back to the free tier. Your projects, drawings and issued certificates stay on your device, and you can still open and export them. The free tier's limits then apply to new work: up to five saved projects, and one free issued job, if you have not already used it.
We may change what the paid tiers include, and we may change our prices. Price changes are made through Google Play, which will tell you before a change affects a renewal.
Features whose absence could make an installation unsafe stay on the free tier. We will not move a safety feature behind a payment.
7. Your work and your data
Ohmly keeps your work on your device. There is no Ohmly account and no copy on our servers, so we cannot recover your work if your device is lost, damaged or reset, and nor can anyone else here.
Please keep your own copy. In Settings you can export your business details, rates, price list and job index to a file, and you can switch on Android's Google Drive backup for your records and signatures. Both are explained in the privacy policy, which also sets out how we handle data.
8. What you must not do
Please do not resell, sublicense or redistribute the app; do not reverse engineer, decompile or modify it, except where the law says you may; do not use it to produce a document you know to be false; and do not present Ohmly as endorsed by a standards body or a scheme provider.
9. Intellectual property
The Ohmly name, the omega mark, the wordmark, the app and this website belong to us. The work you create with Ohmly, including your drawings, records and certificates, is yours, and we claim no rights over it. Third-party components are listed on the licences page.
10. Changes, availability and ending your access
We may update the app, add or remove features, or stop offering it. Because Ohmly runs on your device, an installed copy keeps working whatever happens at our end, and your work stays where it is.
We may change these terms. If a change matters to you we will give you reasonable notice in the app or on this page before it takes effect, and the date at the top of this page always shows the current version.
We may suspend or end your access if you seriously or repeatedly break these terms. If we do, we will tell you why, and you can still export the work held on your device.
11. Our responsibility to you
We are responsible for the software. You are responsible for the electrical work. We will provide Ohmly with reasonable care and skill. We do not promise it will be free of every error or always available, and it is offered as an aid to a competent person rather than as a substitute for one.
We are not liable for the installation, for the inspection and testing, or for anything you certify, nor for any loss arising because output was relied on without being checked as section 3 requires. That responsibility is placed on the competent person by law, and it stays there.
If you use Ohmly for your business, we are not liable for loss of profit, loss of business, loss of contracts, loss of goodwill, or any indirect or consequential loss.
If you are a consumer, we are liable for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not liable for loss or damage that was not foreseeable.
Where we are liable, our total liability for everything connected with Ohmly is limited to £100, or the total you paid for an Ohmly subscription in the twelve months before the claim, whichever is higher.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. Nothing in these terms affects your statutory rights, and nothing in them moves to us a duty that the law places on you as the person carrying out or certifying electrical work.
12. Law, and how to reach us
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your own courts.
